Terms of Service (Thailand)
OVERVIEW
Welcome to StagFit. The terms “we”, “us” and “our” refer to StagFit. StagFit operates this store and website, including all related information, content, features, tools, products and services (the “Services”). StagFit is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (the “Terms”), together with any policies referenced herein, describe your rights and responsibilities when you use the Services.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use or access the Services.
SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least the age of majority under Thai law (20 years old), or you have the consent of a parent/guardian to allow any minor dependents to use the Services on devices you own, purchase, or manage.
To use the Services (including browsing or purchasing), you may be asked to provide information such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, complete, and that you have the rights necessary to provide it.
You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 – OUR PRODUCTS
We make every effort to represent our products accurately. However, colors and appearance may vary by device and settings.
We do not warrant that the appearance or quality of any products or services purchased will meet your expectations or be identical to on-screen images.
All product descriptions are subject to change without notice. We may discontinue products or limit quantities to any person, geographic region, or jurisdiction at our discretion.
SECTION 3 – ORDERS
When you place an order, you are making an offer to purchase. StagFit may accept or decline your order at its discretion. Your order is accepted once we confirm acceptance and process your payment. Please review your order carefully before submitting; cancellation may not be possible after acceptance. If we do not accept, change, or cancel an order, we will attempt to notify you using the contact details provided at checkout.
Your purchases are subject to our Refund/Return Policy. You represent and warrant that your purchases are for personal or household use only, and not for commercial resale or export.
SECTION 4 – PRICES AND BILLING
Prices, discounts, and promotions may change without notice. The price charged will be the price in effect at the time of order placement and will appear in your order confirmation email. Unless expressly stated, posted prices exclude shipping, handling, and any applicable Thai taxes (e.g., VAT) or duties.
Prices on our website may differ from prices elsewhere. Promotions may have separate terms; if there is a conflict, those promotion terms govern.
You agree to provide current, complete, and accurate purchase, payment, and account information, and to promptly update your details so we can complete transactions and contact you as needed.
You represent and warrant that (i) your payment information is true, correct, and complete; (ii) you are duly authorized to use the payment method; (iii) charges will be honored by your provider; and (iv) you will pay all amounts due, including taxes and shipping.
SECTION 5 – SHIPPING AND DELIVERY (THAILAND)
Delivery times are estimates only and not guaranteed. We are not responsible for delays caused by carriers or events outside our control (force majeure). Title and risk of loss pass to you when we hand over the products to the carrier.

SECTION 6 – INTELLECTUAL PROPERTY
The Services (including trademarks, brands, text, images, graphics, video, audio, reviews, and overall design/arrangement) are owned by StagFit or our licensors and protected by Thai and international intellectual property laws.
You may use the Services for personal, non-commercial purposes only. You must not reproduce, distribute, modify, create derivative works, publicly display or perform, republish, download, store, or transmit any material from the Services without our prior written consent. Except as expressly provided, no license or rights are granted under any intellectual property of StagFit, Shopify, or third parties. All rights are reserved.
“StagFit” names, logos, product/service names, designs, and slogans are trademarks of StagFit or our licensors. Shopify’s marks are trademarks of Shopify. Other marks are the property of their respective owners. You must not use any trademark without prior written permission.
SECTION 7 – OPTIONAL TOOLS
We may provide access to third-party tools “as is” and “as available” without warranties or endorsements. Your use is at your own risk and subject to the third party’s terms. Future features or tools will also be part of the Services and subject to these Terms.
SECTION 8 – THIRD-PARTY LINKS
The Services may include materials or links to third-party websites or embedded features. We do not control or endorse third-party content and are not responsible for your use of such sites. Review third-party policies before transacting; any complaints or claims should be directed to the third party.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
StagFit is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with StagFit. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and StagFit, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with StagFit.
SECTION 10 – PRIVACY POLICY
Personal information collected through the Services is governed by our Privacy Policy. Some information may also be processed by Shopify under its policies. Because the Services are hosted by Shopify, certain data may be processed outside Thailand. Please review both policies before using the Services.
SECTION 11 – FEEDBACK
If you submit reviews, ideas, suggestions, proposals, plans, or other content (“Feedback”), you grant StagFit a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for lawful purposes. You represent that you own or control the rights in your Feedback and that it complies with law and these Terms. We may monitor, edit, or remove Feedback at our discretion.
SECTION 12 – ERRORS, INACCURACIES, AND OMISSIONS
Occasionally there may be information on or in the Services that contain typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).
SECTION 13 – PROHIBITED USES
You may use the Services only for lawful purposes and in compliance with Thai law. You must not, directly or indirectly:
(a) use the Services for unlawful or malicious purposes; (b) violate any applicable laws or regulations; (c) infringe intellectual property rights; (d) harass, abuse, defame, or harm others; (e) transmit false or misleading information; (f) upload or re-use material that violates these Terms; (g) send spam or unsolicited promotions; (h) impersonate others; (i) engage in conduct that restricts or inhibits others’ use of the Services; (j) upload malware or malicious code; (k) scrape or collect personal information; (l) bypass security features.
We may suspend, disable, or terminate accounts that violate these Terms.
SECTION 14 – TERMINATION
We may terminate or suspend your access to the Services at any time at our discretion. You remain liable for all amounts due up to and including the date of termination. Sections intended to survive termination (including Intellectual Property, Feedback, Disclaimers, Liability, Indemnification, Severability, Waiver/Entire Agreement, Assignment, Governing Law) will continue to apply.
SECTION 15 – DISCLAIMER OF WARRANTIES
Except as required by Thai law or expressly stated by StagFit, the Services and all products are provided “as is” and “as available.” We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free, or that content will be accurate or complete.
SECTION 16 – LIMITATION OF LIABILITY
To the fullest extent permitted by Thai law, StagFit (including directors, officers, employees, agents, partners, service providers, and licensors) shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages (including lost profits, revenue, data, or savings) arising from or related to your use of the Services or products, even if advised of the possibility of such damages.
SECTION 17 – INDEMNIFICATION
You agree to indemnify, defend, and hold harmless StagFit and our affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising out of your breach of these Terms, violation of law, or misuse of the Services.
SECTION 18 – SEVERABILITY
If any provision of these Terms is unlawful, void, or unenforceable, it shall be enforced to the maximum extent permitted, and the remaining provisions will remain in full force.
SECTION 19 – WAIVER; ENTIRE AGREEMENT
Our failure to enforce any right is not a waiver. These Terms and policies referenced herein constitute the entire agreement between you and StagFit regarding the Services and supersede prior understandings. Any ambiguities shall not be construed against the drafting party.
SECTION 20 – ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations without notice.
SECTION 21 – GOVERNING LAW & JURISDICTION (THAILAND)
These Terms and any related disputes are governed by the laws of the Kingdom of Thailand. You and StagFit agree to the exclusive jurisdiction of the competent courts of Thailand (e.g., courts in Chiang Mai, unless mandatory law specifies otherwise).

Headings are for convenience only and do not affect interpretation.
SECTION 23 – CHANGES TO TERMS OF SERVICE
You can review the most current version of these Terms at any time on this page. We may update these Terms from time to time. Material changes will be notified in accordance with applicable law and become effective on the date specified. Your continued use of the Services after changes take effect constitutes acceptance.
